Urban Forest Savannah Waiver
PLEASE READ CAREFULLY—THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!
THIS RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK (the “Release”) is executed by the below named participant (the “Participant”), in favor of Urban Forest Social House, LLC (“Urban Forest”), a Georgia limited liability company with an address of 119 West Main Street, Prattville, AL 36067, its members, managers, officers, employees, contractors and agents (collectively, the “Releasees”).
I, the Participant, wish to participate in axe throwing recreational activities (the “Activities”) organized, sponsored, managed and supervised by Urban Forest at an indoor recreational axe throwing range located at 410 W Jones St Unit A, Savannah GA 31401 and I hereby grant this Release in consideration therefor.
I, THE UNDERSIGNED PARTICIPANT, FREELY, VOLUNTARILY AND WITHOUT ANY INDUCEMENT OR DURESS EXECUTE THIS RELEASE TO ATTEST TO MY UNDERSTANDING AND AGREEMENT TO THE FOLLOWING TERMS:
I, THE UNDERSIGNED PARTICIPANT, KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, OF INJURY, HARM AND LOSS ASSOCIATED WITH MY INVOLVEMENT AS A PARTICIPANT IN THE ACTIVITIES.
I, THE UNDERSIGNED PARTICIPANT UNDERSTAND AND VOLUNTARILY ACKNOWLEDGE THAT THROWING AXES CARRIES AN INHERENT RISK OF BEING HT BY AN AXE-THROWN OR HELD- DUE TO PARTICIPANT OR STAFF INATTENTIVENESS, NEGLECT, FAILURE TO FOLLOW INSTRUCTIONS, INCORRECT THROWING OR PLAYING TECHNIQUES, ERRORS IN JUDGMENT, INADEQUATE TRAINING, OR PURPOSEFUL OR ACCIDENTAL ASSUALT AND BATTERY BY A PARTICIPANT.
I, THE UNDERSIGNED PARTICIPANT, FURTHER UNDERSTAND AND VOLUNTARILY ACKNOWLEDGE THAT MY PARTICIPATION IN THE ACTIVITES MAY INCLUDE STRENOUS AND PHYSICALLY DEMANDING ACTIONS. I REPRESENT THAT I AM IN GOOD MENTAL AND PHYSCIAL HEALTH AND CAN PARTICIPATE IN THE ACTIVITES WITHOUT CAUSING A DANGER TO MYSELF, STAFF, GUEST AND OTHER PARTICIPANTS AROUND ME.
I, THE UNDERSIGNED PARTICIPANT, UNDERSTAND AND VOLUNTARILY ACKNOWLEDGE THAT PARTICIPATION IN GROUP ACTIVITIES MIGHT LEAD TO CONTACT WITH PERSONS WHO ARE ILL OR CONTAGIOUS WITH ONE OR MORE ILLNESSES, INCLUDING BUT NOT LIMITED TO THE NOVEL CORONAVIRUS (“COVID-19”) AND SUCH CONTACT, EVEN WITH THE SAFTEY PERCAUTIONS IMPLEMENTED BY URBAN FOREST, MAY RESULT IN PERSONAL INJURY, ILLNESS, PERMANENT DISABILITY, AND DEATH.
I, the undersigned Participant, understand and acknowledge to comply with the terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such attention to the nearest employee, agent or manager of Axe House immediately. Additionally, I understand and acknowledge that I will cease all participation in the Activities and inform staff if I feel any unusual discomfort, pain or serious injury.
I, the undersigned Participant, understand and acknowledge that in the event emergency medical care and/ or transportation is required on my behalf, I will assume all costs associated with medical care and transportation.
I, the undersigned Participant, understand and acknowledge that the Releasees do not assume any responsibility for or obligation to provide financial assistance or insurance, including but not limited to medical, health or disability insurance in the event of my injury, illness, death or damage to my property. I understand that I am solely responsible for any such costs or expenses.
I, the undersigned Participant, understand and acknowledge that consumption of alcohol on the premises must be authorized and in compliance with Urban Forest rules and restrictions. I further acknowledge that I if elect to consume, purchase or possess alcohol while engaging in the Activities, I am of legal age to consume, purchase or possess alcohol and agree to assume all risks, known and unknown, related to consuming such alcohol and agree to be fully responsible and liable for any and all claims, demands, damages, losses, injuries, liabilities, obligations, costs, or expenses of any kind which may arise due to my consumption, purchase or possession of such alcohol.
I, the undersigned Participant, understand and acknowledge that I may be photographed or recorded while participating the Activities. I consent to the use of any photographs, pictures, film or videotape take of me or provided by me for publicity, promotion, television, websites or any other use, and expressly waive any right of privacy, compensation, copyright or other ownership right connected to same.
I, the undersigned Participant, hereby release, indemnify, and hold harmless the Releasees, to the fullest extent permitted by law, from any and all liability for loss, theft, cost, expense, injury, illness, death or property damage resulting directly or indirectly from my involvement or participation in the Activities.
I, the undersigned Participant, hereby release and forever discharge, hold harmless and indemnify (including all for costs, damages, and attorneys’ fees) the Releasees and their successors and assigns from any and all liability, claims and demands which I or my heirs, assigns, next of kin or legal representatives may have, make, or which may hereinafter accrue in connection with any bodily injury, personal injury, illness, death or property damage which may now or hereafter arise from or is in any way related to my participation in the Activities, whether caused wholly or in part by the negligence, fault or other misconduct of the Releasees, other participants, or any other persons.
I, the undersigned Participant, expressly agree that this Release shall be governed by Georgia law and that any claim or cause of action arising hereunder shall be adjudicated only in the Superior Court of Fulton County, Georgia. I HEREBY IRREVOCABLY WAIVE ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR MY PARTICIPATION IN THE ACTIVITIES. I further agree that in the event any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining clauses or provisions of this Release, which shall continue in full force and effect.
FOR PARENT/GUARDIANS OF PARTICIPANT OF MINOR (UNDER AGE 18 AT TIME OF REGISTRATION)
This is to certify that I, as a parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the releases, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releases from any and all liability incidents to my minor child’s involvement or participation in these Activities as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
By signing below I also agree that attending as a spectator or participant of or in the Activities I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation, attendance or observation of said Activities.
I, understand that an axe throwing venue is a high-risk area and by voluntarily entering the building I and anyone for whom I am personally responsible KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES.
I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Urban Forest Social House, LLC, its officers, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event, from any and all claims, demands, losses, and liability arising out of or related to any INJURY, ILLNESS, DISABILITY OR DEATH I may suffer, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. I FURTHER IRREVOCABLY WAIVE ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR MY PARTICIPATION AS A SPECTATOR.
